The present article has purpose to analyze, from bibliographic review, the historical, legal and social aspects of children and adolescents adoption by elderly people. The literature review was used, whose bibliographic research was carried out from January to April 2019, through the database of the Institutional Repository of UNESP (University of the State of São Paulo), PUC Digital Library (Pontifical Catholic University) and Scielo (Scientific Electronic Library Online) and Google Scholar. It was verified from this study that the family, the aging and the institute of the adoption underwent changes with the passage of time and according to the society in which they were inserted. It was concluded that, in Brazilian legislation, there is no impediment for elderly adopting children and adolescents, however, in the social imaginary, the association of the elderly with the exercise of avidity persists and not of motherhood or paternity.
